AN ACT TO AMEND CHAPTER 995, LOCAL AND PRIVATE LAWS OF 1998, TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF SOUTHAVEN TO PAY COMPENSATION TO SUMMERSHILL FIRE DISTRICT FOR TERRITORY REMOVED FROM ITS FIRE PROTECTION DISTRICT; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Chapter 995, Local and Private Laws of 1998, is amended as follows:

Section 1. (1) Subject to the provisions of subsection (2) of this section, the governing authorities of the City of Southaven, Mississippi, in their discretion, are authorized to supplement the fire protection services of the Summershill Fire District for territory removed from its fire district.

(2) * * * Such agreement shall be entered into simultaneously with the removal of the property tax imposed for the fire district from the individual landowners * * *.

(3) (a) By agreement of the parties, the City of Southaven, Mississippi, shall pay to Summershill Fire District, as compensation to the district for its loss of tax revenue and dues, an annual amount not to exceed Fourteen Thousand Nine Hundred Eighty-seven Dollars and Ninety-three Cents ($14,987.93), from any available funds, during fiscal year 2000 and each fiscal year thereafter for the next fourteen (14) years or until some party retires or assumes the current debt of the Summershill Fire District.

(b) The City of Southaven, Mississippi, shall be fully and wholly responsible for the fire protection within its corporate limits located within the Summershill Fire District and the Summershill Fire District shall be relieved of any further responsibility for fire protection in those areas that are located within the city limits of the City of Southaven, Mississippi, on or before the effective date of this act.

SECTION 2. This act shall take effect and be in force from and after its passage.
